29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) On May 9, 2025, and at times prior, the employer did not ensure that modifications and/or additions were performed with manufacturers prior written approval as required. The Hyster 80XM forklift, model number K005D05285X, was equipped with 50 inch tines that had been modified as both had after market holes located approximately 8 inches from the each tip. The employer had not received prior written permission from the forklift manufacturer to modify the attachment. The modification to the forks potentially affects the capacity and safe operation exposing employees to struck-by hazards.

29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service: a) On May 9, 2025, and at times prior, the employer did not ensure that the flexible power cord outer insulation jacket to the car refrigeration unit was undamaged. The cord running to the car refrigeration unit was not energized at the time but had potential of 120 volts AC, 20 amps. This condition exposed the employees to the potenital hazard of electrical shock and burns.
