29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section.  a) The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on or about May 12, 2025 at 5631 Apple Creek Drive, Bismarck, North Dakota where employees were not protected from fall hazards greater than 11 feet to the ground while conducting roofing activities on a residential home. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.

29 CFR  1926.502(d)(15): At this job site, the anchorage used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5000 pounds per employee.   a) On May 12, 2025 at 5631 Apple Creek Drive, Bismarck, ND, employees were exposed to a fall greater than 6 feet when installing roofing materials on a 10/12 pitch roof with multiple employees attached to a single anchor point and anchors not properly secured in accordance with manufacture's instructions.  Note:  This Company was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, which was contained in OSHA Inspection Number 1760358, Citation 1, Item 2, and was affirmed as a final order on November 6, 2024 with respect to a workplace located at 303 1/2 Collins Ave, in Mandan, North Dakota.

29 CFR  1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:  a) On May 12, 2025 at 5631 Apple Creek Drive, Bismarck, ND, employees were exposed to a fall hazard when installing roofing materials with multiple employees who had their ropes attached to side or front attachment points of their harnesses.  Note:  This Company was previously cited for a violation of this Occupational Safety and Health standard, or its equivalent standard, which was contained in OSHA Inspection 1760358, Citation 1, Item 3, and was affirmed as a final order on November 6, 2024 with respect to a workplace located at 303 1/2 Collins Ave, in Mandan, North Dakota.
