29 CFR  1926.451(b)(2): Scaffold platform construction. Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.  a) On or about May 8, 2025, the employer did not ensure that the platform of the carpenters scaffold was at least 18 inches  in that an 11 3/4 inch LVL board was being used as the scaffold platform.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a) On or about May 8, 2025, the employer did not conduct adequate inspections of the carpenter's scaffold. Employees were exposed to fall heights greater than 12 ft in that no means of conventional fall protection was being used and the scaffold platform was less than 18 inches.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a) On or about May 8, 2025, an employee was exposed to a fall hazard greater than 12 ft while performing framing work on a residential jobsite on a carpenters scaffold without utilizing a personal fall arrest system or guardrail system.

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart   a) On or about May 8, 2025, the employer failed to ensure that employees performing siding work on a carpenters scaffold were trained by a qualified person to recognize and minimize hazards. Specifically, employees were not trained on the requirement for fall protection systems. As a result, employees were exposed to fall hazards of 12 ft 3 in.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a) On or before May 8, 2025, the employer failed to ensure that employees installing subfloor on a the second story of a residential home were utilizing a personal fall arrest system. Employees were exposed to fall heights greater than 17 ft.
