29 CFR  1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were required by the employer:   On or about May 14, 2025 - Frank Billanti Casting Company, Inc located at 42 West 38th Street Suite 204 , New York, NY 10018.   a) Employees working in the casting room are required to wear respirators such as but not limited to Air Gear Pro G-500 half-face elastomeric respirator while performing tasks such as burnouts  and preparing Ultra-Vest Bandust investment material, which contains 40-50% crystalline silica. The employer did not implement a written respiratory protection program when respiratory protection is required.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19

The employer did not maintain copies of safety data sheets for the chemicals used in the workplace as required.   NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

The employer did not include the hazards related to exposure to respirable crystalline silica in the written hazard communication program.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
