29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  a) Worksite, 729 Mason St, Schenectady, NY, roof -  On or about May 15, 2025, employees were using an aluminum extension ladder to descend from the roof of a residential building approximately 30-feet above the ground. The ladder side rails extended approximately 6-inches above the landing surface. The employer did not provided information in the recognition of hazards related to ladders and the procedures to be followed to minimize these hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Worksite, 729 Mason St, Schenectady, NY, roof -  On or about May 14, 2025, the employer did not ensure all employees working on the roof installing tar paper were connected to fall arrest system 100% of the time while working from a roof exposing them to falls of approximately 20-feet to the ground below.  An employee fell from the roof on May 14, 2025 resulting in fatal injuries.  M. Anthony's Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1482311, citation number 1, item number 2 and was affirmed as a final order on December 28, 2020, with respect to a workplace located at Elisabeth St. Yonkers, NY.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) Worksite, 729 Mason St, Schenectady, NY, roof -  On or about May 15, 2025, an employee was using an aluminum extension ladder to descend from the roof of a residential building approximately 30-feet above the ground. The ladder side rails extended approximately 6-inches above the landing surface.   The M. Anthony's Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.1053(b)(1), which was contained in OSHA inspection number 1482311, citation number 1, item number 3 and was affirmed as a final order on December 28, 2020, with respect to a workplace located at Elisabeth St. Yonkers, NY.
