1910.132(a) Protective equipment, including protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. a.) Bortnick Construction, Inc., Bucket Elevator or line 2 emergency cullet elevator area located at a worksite at 5123 Victory Blvd. Cochranton, PA, on or about May 15th, 2025, and times prior thereto: The employer did not evaluate the workplace to determine if the bucket elevator was a permit required confined space prior to employees initiating work operations in the space. As an employee was maneuvering equipment in the bucket elevator, he was struck-by a falling object resulting in an injury. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.146(d)(1): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not implement the measures necessary to prevent unauthorized entry: a.) Bortnick Construction, Inc., Bucket Elevator or line 2 emergency cullet elevator area located at a worksite at 5123 Victory Blvd. Cochranton, PA, on or about May 15th, 2025, and times prior thereto: Measures were not taken to prevent unauthorized entry into a permit required confined space. Employees performed work tasks within the line 2 emergency cullet elevator with their hands, arms and head crossing the plane of the confined space. An employee was struck by a piece of metal in the space while performing the removal of buckets from the bucket elevator. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
