29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience. (a) On May 8, 2025, an employee performed side grading operations with a Caterpillar 627H Wheel Tractor-Scraper, Model No. C-13, Serial No. TXM3321, on a soil stockpile grade estimated at 100 percent while the machine was articulated. This exceeded the manufacturer's allowable maximum side grade operation with machine articulation of 24 percent grade. The employee had not been provided training on the allowable side grading operation limits or safe operating practices for unstable terrain.
