Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii). a) On or about May 7, 2025, at 101 Hidden Oak Drive, Vero Beach, FL 32963, a tree climber was exposed to fall hazards of approximately 22 feet in that, the employer did not ensure that the employee was protected by a positioning device (body belt and lanyard) at all times while climbing to and descending from the top of a palm tree by use of an extension ladder in combination with a positioning device and spikes to prevent falls from elevation to ground.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee who is required by this section to use personal protective equipment: a) On or about May 7, 2025, at 101 Hidden Oak Drive, Vero Beach, FL 32963, a tree climber was exposed to fall hazards of approximately 22 feet in that, the employer did not ensure that the employee was trained in the safe use of a positioning device (body belt and lanyard) while climbing to and descending from the top of a palm tree by use of an extension ladder in combination with a positioning device and spikes to prevent falls from an elevation to ground.
