OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from excavating equipment: a) 3719 Spring Rd., Kempton Pa, Worksite - On or about May 21, 2025 , the employer did not ensure that other employees were clear of the excavator swing area/danger zone, exposing employees to being struck by or crushed when equipment is in motion.

The employer did not instruct the employee in recognizing workplace hazards and unsafe conditions.
