29 CFR  1910.252(b)(2)(iii):Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields:  a.) On or about May 28, 2025, employees were exposed to welding arc ultraviolet radiation. Three welders were working on a play structure in the center of the shop and there were no welding screens placed around the welders to prevent nearby workers and those walking by from rays. The employer failed to ensure noncombustible or flameproof screens or shields or appropriate goggles were provided to the nearby workers.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   a) On or about May 28, 2025, and at times prior,  the employer did not establish a hazard communication program which included respirable crystalline silica, black magic, or other chemicals used at the facility. OSHA conducted exposure assessments on May 28, 2025, and found one employee sampled had some exposure to respirable crystalline silica at 0.031 mg/m3 at an 8-hour Time-Weighted Average. However, due to the the Sampling and Analytical Error results, silica citations were not issued for being over the Action Level.

29 CFR  1910.1053(j)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200):    a) On or about May 28, 2025, and at times prior,  the employer did not establish a hazard communication program which included respirable crystalline silica. OSHA conducted exposure assessments on May 28, 2025, and found one employee sampled had some exposure to respirable crystalline silica at 0.031 mg/m3 at an 8-hour Time-Weighted Average (above the Action Level). However, due to the the Sampling and Analytical Error results, silica citations were not issued for being over the Action Level. Silica is present during abrasive blasting operations on site.

On or about May 28, 2025, and at times prior, employees were exposed to crush by and tip over hazards. The employer failed to ensure employees were certified and trained to operate a telescopic handler (Ingersoll-Rand Construction and Mining Model No P-10440; Serial No. 178858 VR-1044C) and a Yale propane powered sit down forklift before operating them. On or about May 28, 2025, and at times prior, employees were exposed to dust, specifically particulates not otherwise regulated (Respirable Fraction) above the 8-hour work shift time weighted average limit in Table Z-3 of 5 m g/m3. Personal air sampling was conducted on May 28, 2025 and one of the employees conducting abrasive blasting was exposed to a work environment containing 6.20 mg/m3 of dust (particulates not otherwise regulated).
