29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section: Worksite: 18 Essex Street, West Babylon, NY, 11704. On or about 05/28/2025, Employees were installing shingles on the roof of a two story residential building, approximately 26ft above the ground. The employees were not protected by a means of fall protection and were exposed to falling to the ground below. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. Location: 18 Essex Street, West Babylon, Ny, 11704. On or about 05/28/2025, employees were using a 32-foot extension ladder set up on the front of the building to gain access to the roof of a two story residential home to install asphalt shingles. The ladder did not extend three feet above the landing. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
