OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from the use of makeshift platforms on rough terrain forklifts:   A) Marcus Duarte at the address of 1813 West State Street, New Castle, Pa: On or about May 29, 2025 and times prior thereto: One employee was working from the forks of a JCB Sunbelt rough terrain forklift from a makeshift platform. Employee was exposed to a fall hazard of roughly 18 feet to the pavement below. The platform was not outfitted with guardrails or any other type of fall protection devices.
