29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) TCI Mobility, LLC- On or about May 30, 2025, employees were exposed to a fall hazard of approximately ten (10) feet on an unprotected walking-working surface in a UACU container, and the employer failed to ensure that employees were protected with a guardrail, safety net, or personal fall protection system. b) TCI Mobility, LLC- On or about May 30, 2025, employees were exposed to a fall hazard of approximately ten (10) feet while being raised on the forks of a powered industrial truck and the employer failed to ensure that employees were protected by a fall protection system Abatement certification required.

29 CFR 1910.134(k)(6): The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer. a) TCI Mobility, LLC- On or about May 30, 2025, employees voluntarily wore N95 and P95 respirators, and the employer did not provide training on the use and limitations of the respirators. Abatement certification required.
