29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) On or about May 16, 2025, at 9824 South Industrial Drive, Bridgeview, IL 60455 - Unit F,  the employer did not ensure that a written respiratory protection program was established and implemented for those employees required to wear respiratory protection, including a tight-fitting half-mask respirators with organic vapor cartridge, when working with the following hazardous chemicals: Hydrochloric Acid 37%, Nitric Acid 65%, and Muriatic Acid.   Respiratory protection program shall include, at a minimum the following:  1)  Procedures for selecting respirators; 2) Medical evaluations and fit testing; 3) Procedures for proper use in routine and reasonably foreseeable emergency situations; 4) Procedures for cleaning, storing, inspecting, repairing and discarding respirators; 5) Employee training regarding respiratory hazards they are exposed to, proper uses and limitations of respirators; and 6) Procedures for regularly evaluating the effectiveness of the respirator program.

On or about May 16, 2025, front entrance washroom, the employer did not ensure that employees required to work with corrosive solutions, including but not limited to Hydrochloric Acid 37%, Nitric Acid 65%, and Muriatic Acid, were provided with working facilities for drenching or flushing the eyes and body.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a. On or about May 16, 2025,  the employer did not develop and implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be present in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system and any precautionary measures to protect employees.  An employee was required to work with acids and liquified petroleum (LP) gas to clean jewelry and was exposed to hazardous materials, including but not limited to Hydrochloric Acid 37%, Nitric Acid 65%, and Muriatic Acid.

On or about May 16, 2025, in the workplace, the employer did not complete a written certification of the personal protective equipment assessment. Employees are exposed to acids, including buy not limited to,  Hydrochloric Acid 37%, Nitric Acid 65%, and Muriatic Acid when cleaning gold jewelry.
