29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.) At the worksite, located at 8445 Gardens Cir Sarasota, FL 34243; On or about 5/29/25, the employer failed to ensure protective measures to prevent fall hazards as demonstrated at the worksite where roofing operations were conducted overhead without a fall protection system in place on a residential apartment building approximately 16ft, 21ft and 25 ft in height.   Rooftecs of Florida LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1699214, citation number 1, item number 1 and was affirmed as a final order on 1/30/2024, with respect to a workplace located at located at 8702 New Tampa Blvd, Tampa, FL 33647- building No.9.   Rooftecs of Florida LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1690823 citation number 1, item number 1 and was affirmed as a final order on 10/25/2023, with respect to a workplace located at located at 11510 NW 56th Drive, Coral Springs Florida 33076.

29 CFR  1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:   a.) At the worksite, located at 8445 Gardens Cir Sarasota, FL 34243; On or about 5/29/25, the employer exposed employees to struck by hazards, in that unauthorized and untrained personnel were authorized to operate a JCB 512-56 Telehandler Forklift that was utilized to lift trash can bins and materials approximately 16ft and 25ft in order to perform roofing operations on the 2nd level of a residential apartment building.  Rooftecs of Florida LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.602(d), which was contained in OSHA inspection number #1690823, citation number 1, item number 3 and was affirmed as a final order on 10/25/2023, with respect to a workplace located at located at 11510 NW 56th Drive Coral Springs, FL 33076.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.) a.) At the worksite, located at 8445 Gardens Cir Sarasota, FL 34243; On or about 5/29/25, the employer exposed employees to fall  hazards of approximately 16ft, in that, an extension ladder did not extend 3 ft past the landing surface for employees conducting roofing operations on a residential apartment building.
