OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Ahlers Construction, LLC at 411 Southeast 12th Street, Madison SD, 57042: On or about and at times prior to May 29, 2025, the exposing employer did not ensure employees were protected from struck-by and crushing hazards related to structural collapse of the roof structure in that adequate temporary and/or permanent bracing was not installed to secure roof trusses during truss setting operations. Two employees received serious injury as a result of structural collapse of the roof structure during truss setting operations. Abatement Note: Among other methods, feasible and acceptable methods to correct this hazard are to ensure that all work is conducted in accordance with design criteria established by the Truss Plate Institute - ANSI/TPI 1-2014 and to refer to the Building Component Safety Information ("BCSI") manual for wood truss temporary bracing requirements.

29 CFR 1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)Ahlers Construction, LLC at 411 Southeast 12th Street, Madison SD, 57042: On or about and at times prior to May 29, 2025, the exposing employer did not ensure employees were protected from fall hazards while conducting roof truss setting operations by an appropriate fall protection system. This condition exposed employees to fall hazards greater than four feet.
