29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about May 29, 2025, it was documented that employees performing meat packing/processing in the Harvest and Fabrication sections of Gibbon Packing, LLC. located at 218 East Highway 30, Gibbon, Nebraska were exposed to fall hazards in that the employer did not ensure employees accessing walking working surfaces greater than 4 feet to the next lower level were protected from falling.  Instances of unprotected sides or edges included but were not limited to:  i. Unguarded areas along the catwalk between the Bull Header and the Down Puller where the catwalk walking surface measured approximately 4 feet, 10 inches from the pit top to the just above the blood pooled within the pit.  Specifically, there was approximately 11 inches horizontally unguarded between the wall and the catwalk  guardrail on the Bull Header side, approximately 12 inches horizontally unguarded before start of catwalk guardrail closest to the Bull Header on the Down Puller side, and one chain covering integrated ladder opening on catwalk between the Bull Header and Down Puller on the Down Puller side.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about May 28, 2025, it was documented that employees performing maintenance, servicing, and/or repair activities in the Harvest area of Gibbon Packing, LLC. located at 218 East Highway 20, Gibbon, Nebraska were exposed to struck-by and caught between hazards in that employees working from an overhead walkway were not protected from the moving parts of Down Puller #1 when employees' body parts broke the plane over the walkway guardrail.

29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:  On or about May 30, 2025, it was observed that employees performing maintenance activities in the maintenance area of Gibbon Packing, LLC. located at 218 East Highway 30 were exposed to struck-by hazards in that employees used compressed air measuring approximately 85 pounds per square inch to clean themselves and surrounding area(s).

29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made:  On or about May 29, 2025, it was observed that employees performing meat processing activities in thein the Shipping Department of Gibbon Packing, LLC. located at 218 East Highway 30, Gibbon, Nebraska were exposed to electrical shock and burn hazards in that the employer failed to identify and remove damaged cords from service before use.  Instances included but were not limited to:  i. The Tec 3400-43 Eco-Standby glue gun where the outer insulation was damaged exposing the inner insulated wires and  ii. The extension cord attached to the Tec 3400-43 Eco-Standby where the outer insulation was damaged, exposing live wires.

29 CFR  1910.1026(d)(2)(i): The employer did not perform initial monitoring to determine the 8-hour TWA exposure for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area:  On or about May 12, 2025, it was identified that employees performing welding activities in the Maintenance Department of Gibbon Packing, LLC. located at 218 East Highway 30, Gibbon, Nebraska were exposed to chemical inhalation hazards in that the employer did not evaluate through initial monitoring the potential for employees welding on stainless steel to be exposed to hexavalent chromium.
