29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) Commercial building rooftop, various locations; On or about June 2, 2025, employees were not required to wear eye protection to protect against flying particles while operating pneumatic nail guns to affix asphalt shingles using 1-1/2-inch coil roofing nails.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system:  (a) Commercial building rooftop, various locations; On or about June 2, 2025, employees were not protected from falls, while engaged in roofing replacement activities from a 4:12 pitch roof and near edges, at heights ranging between approximately 21-feet, 8-inches to 28-feet, 7-inches above ground level.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   (a) Commercial building rooftop, south side; On or about June 2, 2025, a 28-foot Werner brand model D6228-2 fiberglass extension ladder was leaned against the south-facing eave and used for rooftop access/egress where the landing surface was approximately 21-feet, 8-inches above ground-level.  The upper side rails of the ladder did not extend at least 3-feet above the landing surface.
