29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  On June 3, 2025, at a worksite located at 656 N. Main Street in Oshkosh, WI; the employer did not ensure that employees operating pneumatic nail guns used appropriate eye or face protection when the potential for eye injuries from flying particles were present.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  On June 3, 2025, at a worksite located at 656 N. Main Street in Oshkosh, WI; each employee, engaged in the installation of a roofing materials on a new construction multi-family residential building with eve edges 19 feet above the lower level, were not protected by guardrail systems, safety net system or personal fall arrest system. Employees were moving stacks of shingles, applying underlayment, and nailing down shingles without connecting their personal fall arrest harnesses to lanyards and anchor points.  Employees were exposed to fall of 19 feet at the eve edges, and over 25 feet at the gable ends of the building.

29 CFR  1926.502(d)(15)(i):  Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as part of a complete personal fall arrest system which maintains a safety factor of at least two:  At a worksite located at 656 N. Main Street in Oshkosh, WI; anchorages used for attachment of personal fall arrest equipment were not installed and used as designed for part of a complete personal fall arrest system when employees were engaged in the installation of a roofing materials on a new construction multi-family residential building with eve edges 19 feet above the lower level:  a) On June 3, 2025, an employee was connected to a hinged roof anchor. One of the base legs of the anchor was not secured with any nails or screws.  b) On June 4, 2025, two employees were connected to a single hinged roof anchor. Another set of two employees were also connected to a single hinged anchor, which had one of the bas legs not secured with nails or screws.  c)  On June 4, 2025, multiple hinged roof anchors, to which employees personal fall protection systems were connected, only had two to three fasteners on one side of their base legs.

The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head:  On June 4, 2025, at a worksite located at 656 N. Main Street in Oshkosh, WI: employees engaged in the installation of a roofing materials on a new construction multi-family residential building with eve edges 19 feet above the lower level, did not have their body harness attachment points located at the center of the wearers' back near shoulder level. Two employees were observed with their attachment points near their middle/lower back.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  On June 3, 2025, at a worksite located at 656 N. Main Street in Oshkosh, WI: the employer did not provide a training program that enabled each employee to recognize the hazards of falling or the procedures to be followed in order to minimized these hazards. Employees who were not connected to fall protection did not recognize the hazard or follow procedure to protect themselves. Employees who were connected hinged roof anchors did not recognize or follow procedures for affixing the anchors. Employees whose harnesses did not have the attachment point in the center of their back near their shoulders did not recognize the hazard of improperly wearing a fall harness.
