(a)Berkshire Mall, 1665 State Hill Rd, Wyomissing, PA - On or about June 5, 2025, an employee was working from a ladder jack scaffold that was more than 10 feet above the lower level without utilizing any method of fall protection. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a)Berkshire Mall, 1665 State Hill Rd, Wyomissing, PA - On or about June 5, 2025, two workers utilized a portable ladder to access a flat roof that was approximately 15 feet above grade. The side rails of the ladder did not extend at least 3 feet above the upper landing surface. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. (a) Berkshire Mall, 1665 State Hill Rd, Wyomissing, PA - On or about June 5, 2025, two workers worked on a flat roof, at locations 18 feet above a lower level and in excess of 36 feet above grade, without utilizing complete methods of fall protection. Aaron King DBA York Commercial Roofing was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.501(b)(10) , which was contained in OSHA inspection number 1781081 , citation number 1, item number 1 and was affirmed as a final order on December 3, 2024, with respect to a workplace located at 370 Carea Road, New Park, PA 17352. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
