29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity: a) 263 Walmart Drive, Camden, DE: On or about June 6 , 2025, Employees were allowed to work from a scaffold that had not been inspected by a competent person prior to the start of the work shift. The scaffold was later found to have defective components, including a damaged or missing railing system, which is required for fall protection. The employer failed to ensure proper inspection of the scaffold for visible defects that could compromise worker safety.

29 CFR 1926.451(g)(1)(v): Each employee on a walkway located within a scaffold was not protected by a guardrail system (with a minimum 200 pound top rail capacity) installed within 9.5 inches (24.1 cm) of and along at least one side of the walkway. a) 263 Walmart Drive, Camden, DE: On or about June 6 of 2025, Employees were working approximately 18 feet above grade on scaffolding where the guardrail system in place on the walkway was defective and non-compliant. The top rail, consisting of a chain link, was improperly secured to a gate using a wire at a connection point not designed or rated to withstand the required 200 pounds of force. This compromised the structural integrity of the guardrail system and failed to provide adequate fall protection to workers using the scaffold walkway.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: a) 263 Walmart Drive, Camden, DE: On or about June 6 , 2025, it was determined by the compliance officer that employees working on and beneath the scaffolding did not maintain a clear walking working surface which increased the possibility of multiple tripping hazards throughout the immediate area where construction was observed and work activities occurred.
