29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: On or about June 5, 2025, at a job site located at 1392 Terrace Ave, Erie, CO employees working in a trench with an (active) unsupported and exposed pressurized water line were not protected from cave-in hazards associated with/due to water accumulation. There were visible signs of water saturation at the open end of a water pipe located in the bottom of the trench approximately 15.5 feet in depth and pooling occurred at various locations throughout the surface areas around open trench thus reducing stability and potentially contributing to soil movement/ sloughing.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about June 5, 2025, at a job site located at 1392 Terrace Ave, Erie, CO the employer did not ensure that a daily inspection of the trench and its surrounding area was conducted by a Competent Person. Responsibilities of the Competent Person include but are not limited to, assessing soil type to determine appropriate cave-in protection; ensuring that appropriate means of access and/or egress is provided; assessing weather conditions to determine if the trench/excavation has been compromised (e.g.: water accumulation, fissures, sloughing, etc.). There were visible signs of water accumulating near the open end of a water pipe and pooling on the surface around the open trench. Employees working in a trench that measured (approximately) 15.5 feet deep were not protected against cave-in hazards due to water accumulation.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: On or about June 5, 2025, at a job site located at 1392 Terrace Ave, Erie, CO the employer did not ensure that cave-in protection was provided and utilized to protect employees working inside of a trench which measured (approximately) 15.5 feet deep during the installation of a water main/line(s). Additionally, there were visible signs of water accumulation near the open end of a water pipe and pooling on the surface around the open trench increasing the potential of exposure to hazards created by the unprotected trench. An excavator was also parked at one of the trench ends.
