OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to atmospheric hazards in confined spaces:  (a)Automated Waste Systems at 45144 289th Street, Viborg, SD 57070: On or about and at times prior to June 6, 2025, the employer did not ensure employees were protected from hazards associated with permit-required confined spaces in that the employer had not developed a written permit space program covering employee entry into the manure collection pit. This condition exposed employees to hazards such as, but not limited to, hydrogen sulfide gas.  Abatement Note:  Among other methods, feasible and acceptable abatement methods to correct this hazard are: i) Conduct site identification and evaluation procedures as established in ANSI Z117.1 - 2022, Section 3 ii) Develop and implement confined space training and procedures as established in ANSI Z117.1 - 2022, Section 4 iii) Implement, provide, and verify understanding of entry team responsibilities as established in ANSI Z117.1 - 2022, Section 7. iv) Implement safeguards such as the use of rescue and retrieval equipment outlined in ANSI Z117.1 - 2022, Section 12.
