OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a.) On or about June 3, 2025, at the Gateway Lofts project, the employer exposed employees to struck-by and crushed-by hazards while hoisting roof trusses with a Genie GTH-1056 all-terrain forklift. Employees were observed sliding a polyester sling directly over a fork tine of the forklift to suspend and lift roof trusses into place. The Genie GTH-1056 Operator's Manual specifically prohibits this practice, stating: ?	"Do not suspend loads using slings or chains from the forks or fork carriage." ?	"Only properly designed, tested and approved attachments, designated lifting points, and lifting accessories should be used to support a suspended load."

29 CFR  1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service.   a) On or about June 3, 2025, the employer failed to ensure that defective rigging equipment was removed from service, in that a polyester rigging strap with several deep cuts exposing the internal red warning threads was used to free-rig wood trusses on the forks of an all-terrain forklift. As a result, employees were exposed to struck-by and crushed-by hazards.

29 CFR  1926.251(e)(8)(iii) Removal from service. Synthetic web slings shall be immediately removed from service if any of the following conditions are present: Snags, punctures, tears or cuts;  a) On or about June 3, 2025, the employer failed to remove from service a synthetic rigging strap with deep cuts exposing the red warning threads, which was used to hoist wood trusses from the ground to the roof with an all-terrain forklift. As a result, employees were exposed to crushed-by hazards in the event of rigging failure.

29 CFR  1926.601(b)(14):All vehicles in use shall be checked at the beginning of each shift to assure that the following parts, equipment, and accessories are in safe operating condition and free of apparent damage that could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. All defects shall be corrected before the vehicle is placed in service. These requirements also apply to equipment such as lights, reflectors, windshield wipers, defrosters, fire extinguishers, etc., where such equipment is necessary.  a.) On or about June 3, 2025, the employer failed to ensure that the all-terrain forklift was checked to be in good operational condition before employees used the all-terrain forklift to perform functions on the job-site in that the all-terrain forklift showed signs of multiple oil leaks from underneath the forklift, on the rear cage, the under-belly, and on top of the forklift where the boom rest at. Exposing employees to crushed-by or struck-by hazard from a malfunctioning all-terrain forklift.
