29 CFR  1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  (a) At the jobsite located at 976 Mandalay Avenue Clearwater, Florida: On or about June 06, 2025, the employer did not maintain a safety and health program addressing  hazards associated with roof repair activities, exposing an employee to fall hazards from lack of fall protection.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  (a) At the jobsite located at 976 Mandalay Avenue Clearwater, Florida: On or about June 06, 2025, an employee without fall protection were exposed to an approximately 11-foot, 6-inch fall hazard while performing roof repair activities around a skylight opening on a 3 in 12 pitched roof.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) At the jobsite located at 976 Mandalay Avenue Clearwater, Florida: On or about June 06, 2025, an employee was exposed to an approximately 11-foot, 6-inch fall hazard while performing roof repair activities on a 3 in 12 pitched roof, in that fall protection was not utilized.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) At the jobsite located at 976 Mandalay Avenue Clearwater, Florida:  On or about June 06, 2025, an employee was exposed to fall hazards above 6-feet high, in that, they were not provided training on how to recognize and minimize fall hazards while working on roofs.
