OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  a) On or about and at times prior to June 09, 2025, at 16224 Opal Creek Drive, Weston FL 33331, employees were exposed to high heat from direct sunlight while performing landscaping operations for three hours. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 26? to 31? (80? to 97?), with a heat index reaching up to 99 degrees Fahrenheit during this period. The employees were engaged in moderate manual labor while wearing sun hats, long sleeves, and long pants. Such prolonged exposure to these conditions significantly increases the risk of serious heat-related illnesses, including heat cramps, heat stress, heat exhaustion, and heat stroke.
