OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards created by the employer's failure to immediately remove automotive lifts from service after lift operators reported deficiencies including hydraulic leaks, unusual noises, erratic operation and evidence of chips or filings. a) Jobsite, Bay Five, 101 Evans City Road, Butler, PA 16001: On or about May 29, 2025, a Forward brand 14,000-pound capacity four-post surface mounted automotive lift (model number CR14111000, serial number 00C06H0014) was not immediately removed from service when lift operators reported multiple deficiencies including unusual loud noises, visual evidence of chips or filings near the pulley and cables and the back left lock failure to engage. The lift failed while being used to lift a minivan which caused the vehicle to unexpectedly drop to the floor. b) Jobsite, Bay Four, 101 Evans City Road, Butler, PA 16001: On or about May 29, 2025, a two-post automotive lift (8000-pound capacity) was not immediately removed from service after lift operators reported that the lift was leaking hydraulic fluid.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Jobsite, shop area, 101 Evans City Road, Butler, PA 16001: On or about June 3, 2025, a storage area above the employee restroom was not equipped with guardrails along all unprotected sides and edges. Employees retrieving materials from the loft were exposed to a fall hazard of approximately 8 feet 6 inches to the floor below.
