29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: Worksite: 7 Equine Ave, Saint James, NY 11780. On or about 06/08/2025, an employee was tossing bales of hay through the barn door on the second floor 11 feet above the ground. The barn door had an open edge and was missing a guardrail system. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
