29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about June 10, 2025, the portable ladder being used by employees to access the roof of the structure did not extend at least three feet above the upper point of contact with the eave nor was it secured in place. This exposed employees accessing and egressing the roof, to a fall hazard of approximately 8 feet onto the grass covered ground.

1926.503(c)(3) Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. (a) On or about June 10, 2025, employees conducting roofing repairs on a 4:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 8 feet at the eave to 15 feet at the gabled ridge end. Semper Fi Roofing, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) which was contained in OSHA inspection number 1629375 citation number 2, item number 2, and was affirmed as a final order on April 11, 2023 , with respect to a workplace located at 344 West South St., Oconomowoc, WI 53066.
