29 CFR 1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Tess Roofing and Construction, Inc. at 2410 Sunrise Ridge Circle, Brookings, SD 57006: On or about and at times prior to May 28, 2025, the controlling employer did not ensure that frequent and regular inspections were conducted by a competent person. This condition exposed subcontractor employees to various hazards such as fall hazards and a lack of training. Tess Roofing and Construction, Inc.., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1604370, citation number 1, item number 2a, and was affirmed as a final order on December 6, 2022, with respect to a workplace located at 216 West Second Street South, Brookings, SD 57006.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a)Tess Roofing and Construction, Inc. at 2410 Sunrise Ridge Circle, Brookings, SD 57006: On or about and at times prior to June 10, 2025, the controlling employer did not ensure that subcontracted employees were protected from fall hazards, in that employees were conducting roofing operations on a 4:12 pitch, multi-story residential property without the use of a fall protection system. This condition exposed employees to fall hazards greater than six feet. Tess Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10 ) which was contained in OSHA inspection number 1604370, citation number 1, item number 2a and was affirmed as a final order on December 6, 2022, with respect to a workplace located at 216 West Second Street South, Brookings, SD 57006.
