29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) At the job site located at 1261 South Sagebrush Ct. Wichita, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the job site. Employees were handling CertainTeed Highland Slate algae-resistant (AR) asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant and gasoline. The chemical hazards associated with these chemicals include: skin, eye and respiratory irritation, redness, itching and burning, drowsiness and/or dizziness, is suspected of causing cancer and may be fatal if swallowed and enters airways.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) At the job site located at 1261 South Sagebrush Ct. Wichita, Kansas, employees engaged in roofing activities were exposed to chemical hazards in that they were not provided training on the chemical hazards of CertainTeed Highland Slate algae-resistant (AR) asphalt shingles, Mule-Hide Products JTS 1 joint & termination sealant and gasoline.
