29 CFR 1926.20(b) Accident Prevention Responsibilities. (2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On June 10, 2025, the employer failed to ensure that adequate frequent and regular inspections of the job site were conducted. As a result, four employees performing framing work without a fall protection system were exposed to a fall hazard greater than 12'9''. Elvis Diaz Miranda dba Elvis Diaz Construction was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1746612, citation number 1, item number 1, and was affirmed as a final order on 09/06/2024, with respect to a workplace located at 4186 Foxpoint Ridge Drive, Cleves, OH 45002.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) On June 10, 2025, the employer did not ensure that employees were utilizing a fall protection system while performing framing work on a newly constructed residential structure. As a result, four employees were exposed to a potential fall height measured to be greater than 12'9''. Elvis Diaz Miranda dba Elvis Diaz Construction was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1746612, citation number 1, item number 2, and was affirmed as a final order on 09/06/2024, with respect to a workplace located at 4186 Foxpoint Ridge Drive, Cleves, OH 45002.
