29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Tobeyco Manufacturing Co Inc., 165 Cedar Street, Corning, NY - Lathe Area. On or about June 6, 2025, employees were permitted to operate Royal Lathe #4003, without guarding to protect from point of operation, rotating hazards, and moving parts. b) Tobeyco Manufacturing Co Inc., 165 Cedar Street, Corning, NY - Lathe Area. On or about June 4, 2025, an employee was permitted to operate Hardinge, Super-Precision Lathe #4005, without guarding to protect from point of operation, rotating hazards, and moving parts. c) Tobeyco Manufacturing Co Inc., 165 Cedar Street, Corning, NY - Grinding Area. On or about June 4, 2025, an employee was permitted to operate Clausing, Colchester 17 Lathe #4008, without guarding to protect from point of operation, rotating hazards, and moving parts. d) Tobeyco Manufacturing Co Inc., 165 Cedar Street, Corning, NY - Grinding Area. On or about June 11, 2025, a written hazard communication program was not developed for the employees who work with hazardous materials including but not limited to: metal cutting fluids, compressed gases, cleaning solvents and powder coatings.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required safety data sheets for each hazardous chemical in the workplace: a) Tobeyco Manufacturing Co Inc., 165 Cedar Street, Corning, NY - Throughout the site. On or about June 11, 2025, Safety Data Sheets (SDS) were not maintained and readily available at the site for employee use. The hazardous material used by workers throughout the site included, but was not limited to, metal cutting fluids, compressed gases, cleaning solvents, and powder coatings.
