29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  Location: 72 Staniford St, Boston, MA  On or about May 29, 2025, workers were exposed to silica dust where the employer did not fully and properly implement the engineering controls and work practices specified for the task on Table 1 paragraph (x) and employees who were operating hand-held powered chipping tools to remove concrete to expose cables in an underground parking garage. Controls required by this section included use of a tool equipped with commercially available shroud and dust collection system. Workers were using a Hilti TE 700-AVR without attachable shroud and Rigid HD09001 dust collection system with VF4000 filters, which are not designed for use with silica dust.

29 CFR  1926.1153(f)(1):The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods were feasible:  Location 72 Staniford St, Boston, MA  On or about May 29, 2025, the employer allowed dry sweeping for employees cleaning concrete debris generated from chipping activity to remove concrete to expose cables in an underground parking garage, where such activity could contribute to employee exposure to respirable crystalline, and HEPA-filtered vacuuming was feasible. Bulk sample of the concrete debris showed a composition of 20% silica and inadequate dust collection system was being utilized as workers were using a Rigid HD09001 dust collection system with VF4000 filters, which are not designed for use with silica dust.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103):  Location: 72 Staniford St, Boston, MA  On or about May 29, 2025, where half- and full-facepiece respirators with tight-fitting facepieces were worn by employees doing chipping and sweeping operations in an underground parking garage, exposing them to silica dust, employees had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function.
