29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  a) Jobsite located at or near 821 N. 19th Street, Philadelphia, PA - On or about June 16, 2025,  the employer did not ensure that each working level of a scaffold was fully planked or decked between the front uprights and guardrail supports. Employees conducting masonry activities were utilizing a scaffold platform that was not fully planked, thereby exposing employees to fall hazards or approximately 28 feet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a) Jobsite located at or near 821 N. 19th Street, Philadelphia, PA - On or about June 16, 2025, the employer did not ensure that employees were provided safe means to access and egress the scaffold. Employees utilized the scaffold supports to access the 4th level of the scaffold platform, thereby exposing employees to fall hazards of approximately 28 feet.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) Jobsite located at or near 821 N. 19th Street, Philadelphia, PA - On or about June 16, 2025, the employer did not ensure that employees conducting brick laying activities from a supported tubular welded frame scaffold, approximately 28 feet above the ground level, were protected from falls by the use of a fall protection system, thereby exposing employees to fall hazards of approximately 28 feet.  David's Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1689315, Citation Number 1, Item number 2 and was affirmed as a final order on 3/6/2024, with respect to a workplace located at 116 S. 12th St., Philadelphia, PA 19107.

29 CFR  1926.454(a): The employer did not have each employee who performed work on a scaffold be trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards.   a) Jobsite located at or near 821 N. 19th Street, Philadelphia, PA - On or about June 16, 2025, the employer did not train an employee working from the 4th level of a supported tubular welded frame scaffold who was exposed to an approximate 28 foot fall hazard, to recognize the hazards associated with working from scaffolds and to understand the procedures to control or minimize those hazards.  David's Construction, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1689315, Citation Number 1, Item number 1, Group Letter b and was affirmed as a final order on 3/6/2024, with respect to a workplace located at 116 S. 12th St., Philadelphia, PA 19107.
