29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a.) On or about June 16, 2025, and at times prior, employees were exposed to silica inhalation hazards while cutting on concrete masonry unit (CMU) blocks and concrete slab. The employee was using a handheld power saw that was not equipped with either an integrated water delivery system that continuously feeds water to the blade, per the engineering and work practice controls specified in Table 1 of 1926.1153 (silica standard). The employer failed to ensure employees were following Table 1 while performing masonry tasks involving concrete cutting.  b.) On or about June 16, 2025, and at times prior, employees were exposed to silica inhalation hazards while using a hammer drill on concrete masonry unit (CMU) blocks. The employee was using a handheld drill that was not equipped with a commercially available shroud or cowling with a dust collection system, per the engineering and work practice controls specified in Table 1 of 1926.1153 (silica standard). The employer failed to ensure employees were following Table 1 while performing masonry tasks involving concrete drilling. 29 CFR  1926.1153(d)(1): The employer did not ensure that employees were not exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA:  a.) On or about June 16, 2025, and at times prior, employees were exposed to silica inhalation hazards while cutting on concrete masonry unit (CMU) blocks and concrete slab.
