(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  On or about June 12, 2025, at a workplace located at 119 Charles Street, Oconto, Wisconsin in the Forming Department; employees engaged in setup work, including but not limited to, tightening clamps and attaching vacuum hoses on the MAAC 16 thermoforming machine were not provided with fall protection when working above four feet exposing them to fall hazards.

29 CFR  1910.28(b)(3)(iv): Each employee is protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used:   On or about June 12, 2025, at a workplace located at 119 Charles Street, Oconto, Wisconsin in the Forming Department; the MAAC 16 access ladder leading up to the top platen was not equipped self-closing swing gate or offset exposing employees to a fall hazard.

29 CFR  1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  On or about June 12, 2025, at a workplace located at 119 Charles Street, Oconto, Wisconsin in the Forming Department; employees authorized to perform setup activities on the thermoforming machines were not trained as an authorized employee under the control of hazard energy requirements.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a) On or about June 12, 2025, at a workplace located at 119 Charles Street, Oconto, Wisconsin in the Forming Department; employees were exposed to machine hazards associated with moving parts when they engaged in setup activities on the MAAC 16 thermoforming machine. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to perform setups. The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity exposing employees to pinch points and/or crushing hazards.   b) On or about January 22, 2025, at a workplace located at 119 Charles Street, Oconto, Wisconsin in the Forming Department; employees were exposed to machine hazards associated with moving parts when they engaged in setup activities on the MAAC 13 thermoforming machine. The employer did not ensure that employees implemented energy control applications steps or equivalent protective measures prior to allowing them to setup. The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity exposing employees to pinch point and/or crushing hazards.   As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.
