29 CFR 1910.29(b)(1): The employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11 of this section): a.) LECOM-Parkside at North East, Basement platform area, on or about June 17th, and times prior thereto: The top rail height of the guard rail system at the entry/exit platform to the basement was measured at approximately 33 inches. The height of the top rail exposed employees to a fall hazard during walking or work operations in this area. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

LECOM-Parkside at North East, Resident storage area next to maintenance shop, on or about June 17th, and times prior thereto: Materials including, but not limited to, computer chairs, and metal shower chairs were stored on top of lockers. The storage of material was in such a manner to posed a struck by hazard for employees that walk through the area. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
