29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer did not ensure each employee on a walking working surface 4 feet (1.2 m) or more above a lower level is protected from falling by one of the systems listed in 1910.28(b)(15)(i)-(iii).  a) On or about and times prior to July 24, 2025, in the Upper Retort's mezzanine area, the employer did not ensure that the guardrail was completely enclosed when material handling equipment (i.e., forklifts) were utilized. Employees traveling to and from the cook/fill rooms were exposed to a fall hazard greater than 4ft above the lower level due to a removeable guardrail section left open.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  The employer failed to develop energy control procedures in the workplace to control hazardous energy sources (e.g., electric, pneumatic, etc.) on production equipment prior to assigning personnel to perform maintenance and servicing activities such as, but not limited to, setup, adjustments, teardown, inspections and repairs.  a) On or about May 21, 2025, in the Tiromat Room, the employer failed to develop machine specific lockout tagout procedures for the Tiromat packaging machine (Model 664/0350) to ensure maintenance personnel were protected from the unexpected energization when engaged in covered activities (i.e., disassembly, troubleshooting, repair). Employees' hands/arms were exposed to be crushed or caught in the Tiromat's sealing plate exposing employees to crushing and thermal hazards.  b) On or about May 24, 2025, in the Pouch Room, the employer failed to develop machine specific lockout tagout procedures for the Prodo-Pak filling machine (Model PV215-TW-10) to ensure operators were protected from the unexpected energization when engaged in covered activities (i.e., setup, adjustments, teardown). Employees' hands/arms were exposed to be crushed or caught in from moving parts such as but not limited to the Prodo-Pak's sealing plate, blade, and reciprocating filling heads.
