29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  The employer fails to require employees to use any form of fall protection when engaged in framing activities for residential construction, exposing them to fall hazards.  This was most recently documented on June 23, 2025, at 3646 N Bristol Ct, Wichita, KS 67226, where employees were exposed to fall hazards when they engaged in residential framing activities at heights greater than 6 feet above ground level and did not use any form of fall protection.  Adolfo Vazquez was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1626523, citation number 1, item number 1 and was affirmed as a final order on January 24, 2023, with respect to a workplace located at 2420 Doris Ave. in Wichita Kansas.  Adolfo Vazquez was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1503371, citation number 1, item number 1 and was affirmed as a final order on February 09, 2021, with respect to a workplace located at 1142 W Ledgestone St Andover Kansas.  Adolfo Vazquez was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1495740, citation number 1, item number 1 and was affirmed as a final order on December 1, 2020, with respect to a workplace located at 1701-1810 N. Newberry Circle, Derby, Kansas.

29 CFR  1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.  At the job site located at 3646 N Bristol Ct, Wichita, KS 67226, employees engaged in powered industrial truck operation was exposed to struck-by hazards. An employee was operating a TL642D CAT telehandler and was not certified by the employer to operate it.
