29 CFR 1910.28(c): When an employee was exposed to falling objects, the employer must ensure that each employee wears head protection that meets the requirements of subpart I of this part. In addition, the employer did not protect employees from falling objects by implementing one or more of the following methods listed in 1910.28(c)(1)-(3): a) 49 Londonderry Lane, Somers, NY 10589 in the wooded area at the rear of the house: The employer did not ensure that employees wore a protective helmet when working in areas where there was a potential for injury to the head from falling objects. On 06/23/2025, an employee was fatally injured when a branch broke off from a falling tree and struck the employee on the head. Note The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation as normally required by CFR 29 CFR 1903.19.

29 CFR 1910.28(c)(3): When employees were exposed to falling objects, the employer did not barricade the area into which objects could fall and prohibit employees from entering the barricaded area: a) 49 Londonderry Lane, Somers, NY 10589 in the wooded area at the rear of the house: On or about 06/23/2025, employees were exposed to falling tree debris during tree cutting operations. An employee was fatally injured when he was struck by a branch that broke off from a falling tree. A barricade was not used to keep employees away from the drop zone. Note The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation as normally required by CFR 29 CFR 1903.19.
