29 CFR 1910.28(b)(1)(i):Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): Location: 50 West 33rd Street, New York, NY 10001 On or about: June 23, 2025 (a) The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge more than 4 feet above a lower level was protected from falling; an employee was engaged in cleaning while standing with one foot on a horizontal brace of a sidewalk shed and his other foot on a protruding building structure. The employee was not protected from falling by guardrail systems, personal fall protection systems, or equivalent.
