29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale (dBA), or equivalently a dose of fifty percent:  (a) On or about June 30, 2025 and at times prior, employees were exposed to an 8-hour time-weighted average (TWA8) sound level of 87.1 dBA (67% dose equivalent) while operating a die cast machine. The employer's hearing conservation program was ineffective in that:     1. Employees exposed to sound levels in excess of 85 dBA TWA8 were not provided audiograms.      2. The employer did not ensure that hearing protectors were worn by employees exposed to sound levels in excess of 85 dBA TWA8 and who had not received a baseline audiogram.      3. Training on noise hazards and use of hearing protectors was not provided to employees who may be exposed to sound levels in excess of 85 dBA TWA8.

29 CFR  1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  (a) On or about June 30, 2025 and at times prior, employees who were exposed to an 8-hour time-weighted average sound level of 87.1 dBA (67% dose equivalent) were not trained on the  effects of noise on hearing, purpose, advantages and disadvantages of types of hearing protectors, and purpose & procedures of audiometric testing.
