29 CFR  1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  (a)DaPro, LLC at 403rd Avenue, Huron, SD 57350: On or about and at times prior to June 26, 2025, the employer did not ensure employees were protected from fall hazards when working on the retractable access platform in the receiving area of the facility, in that the platform did not include a continuous guardrail system along the platform perimeter. This condition exposed employees to fall hazards.   (b)DaPro, LLC at 403rd Avenue, Huron, SD 57350: On or about and at times prior to June 26, 2025, the employer did not ensure employees were protected from fall hazards when working on the retractable access platform in the loadout area of the facility in that the platform did not include a continuous guardrail system along the platform perimeter. This condition exposed employees to fall hazards.

29 CFR 1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  (a)DaPro, LLC at 403rd Avenue, Huron, SD 57350: On or about and at times prior to June 26, 2025, the employer did not ensure employees were protected from fall hazards in that the west guardrail system of the retractable access platform in the loadout area was not inline with the platforms toe board. This condition created a gap between the west external edge of the retractable platforms toe board and the internal face of the west guardrail system.  This condition exposed employees to fall hazards.

29 CFR  1910.29(f)(4): Openings in stair rails. The employer did not ensure that no opening in a stair rail system exceeds 19 inches (48 cm) at its least dimension.  (a)DaPro, LLC at 403rd Avenue, Huron, SD 57350: On or about and at times prior to June 26, 2025, the employer did not ensure employees were protected from fall hazards in that the stair system of the elevated platform in the receiving area did not include a midrail, creating openings between the stair treads and the top rail that exceeded 19 inches at its least dimension. This condition exposed employees to fall hazards.

29 CFR  1910.212(a)(2):Guard(s) on machine(s) were not affixed to the machine or secured elsewhere when attachment to the machine was not possible:  (a)DaPro, LLC at 403rd Avenue, Huron, SD 57350: On or about and at times prior to June 26, 2025, the employer did not ensure employees were protected from caught-in hazards in that the expanded metal guard on the M-500 auger in the load out area was not secured to prevent displacement during operation. This condition exposed employees to caught-in hazards.
