29 CFR 1910.266(h)(1)(i): Trees were felled in a manner that created a hazard for an employee, such as but not limited to, striking a rope, cable, power line, or machine: On June 16, 2025, a 22-inch diameter about 100 feet tall tree was cut in a way which created conditions that resulted in the tree striking tree stump and deflecting toward the employee landing on him. The employee (faller) sustained a crushing injury.

29 CFR 1910.266(h)(2)(i): Before felling started, the feller did not plan and clear a retreat path: On June 16, 2025, the employee did not clear a safe escape path away from the tree. In that the 22-inch diameter, about 100 feet tall tree was cut in a way which created conditions that resulted in the tree striking tree stumps and deflected toward the employee and landed on him. The employee had about 10' 10" (measured) escape path.

29 CFR 1910.266(i)(10)(i): The employer did not verify compliance with paragraph (i) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted prior to the employee's hiring or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate. On or about June 16, 2025, and at times prior, the employer did not verify compliance with the training requirements of this section by preparing and maintaining a written certification record.
