OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  Worksite at/near 14A Shoreview Lane, Danbury CT: On or about and at times prior to June 24, 2025, employees were exposed to the hazard of high heat from the sun and high humidity during the performance of moderate physical labor and landscaping related tasks such as weed whacking, raking, and clearing foliage for approximately 8 hours.  Wet Bulb Globe Temperature (WBGT) values calculated for near the jobsite area using data from National Oceanic and Atmospheric Administration (NOAA) on June 24th ranged between 29-34� Celsius  (84 to 94� Fahrenheit), with humidity ranges between 36 and 65 %. Heat index values calculated for the site were up to 104� F. The high temperatures reached during the work day are above the National Institute for Occupational Safety and Health (NIOSH) Recommended Action Limit for acclimatized workers. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat exhaustion, heat stroke, and death.  The employee was recovering from a recent illness and appeared unwell during the day. The employee had to bring their own water instead of being supplied it by the company and did not receive heat safety training. The worker then collapsed while alone and was pronounced deceased with an extremely high core body temperature.
