29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:   a) City Overlook Townhomes: On or about June 25, 2025 and times prior, the employer exposed employees to fall and struck-by hazards in that the employer did not perform frequent and regular inspections to the extent that hazards were identified and mitigated while employees were building decks utilizing nail guns at a height of over 10 feet to ground level without fall protection or safety glasses.

29 CFR  1926.102(a)(1):The employer did not ensure employees used eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) City Overlook Townhomes: On or about June 25, 2025, the employer exposed an employee to struck-by hazards in that the employer did not ensure an employee was wearing eye protection when using a nail gun to build a deck at a height over 10 feet to the ground level.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) City Overlook Townhomes: On or about June 25, 2025 the employer exposed an employee to fall hazards in that the employer did not ensure the employee was wearing fall protection while building a deck at a height over 10 feet to ground level.
