29 CFR 1910.28(b)(13)(ii): The employer did not ensure that when work is performed at least 6 feet (1.6 m) but less than 15 feet (4.6 m) from the roof edge, each employee is protected from falling by using a guardrail system, safety net system, travel restraint system, or personal fall arrest system. The employer may use a designated area when performing work that is both infrequent and temporary.  a) On June 26, 2025, on a low-slope roof, the employer exposed employees to a fall hazard of approximately 14 feet, 6 inches to the lower ground level, in that an employee using a material hoist located at the roof edge was not protected by a guardrail system, safety net system, travel restraint system, or personal fall arrest system.

29 CFR  1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  a) Roof: On June 26, 2025, on a low-slope roof, the employer exposed employees to a fall hazard of approximately 14 feet, 6 inches to the lower level in that skylights were not guarded or otherwise protected while employees were installing or maintaining weather data machines.

When an employee is exposed to falling objects, the employer did not ensure that each employee wears head protection that meets the requirements of subpart I of this part. And/or the employer did not protect employees from falling objects by implementing one or more of the following methods listed in 1910.28(c)(1)-(3).  a) Ground level, Express Service Bay Exit: On June 26, 2025, the employer exposed employees to struck-by hazards from falling objects, including the weather data machine, in that employees working on the ground were not provided with or did not use head protection while materials were being hoisted to the roof for installation.

29 CFR 1910.30(a)(1): The employer must provide training to each employee who uses personal fall protection systems, or who is required to be trained under this subpart, before the employee is exposed to any fall hazard. The employer must also ensure that employees are trained in accordance with these requirements on or before May 17, 2017.  a) On or about June 27, 2025, the employer exposed employees to fall hazards of approximately 14 feet on a roof without first providing training on the hazards associated with falls or the procedures to minimize those hazards.
