29 CFR  1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  On or about June 25, 2025, at 6250 NW Barry Road, Kansas City, MO, the employer did not initiate and maintain a safety program to protect employees working in or near vehicular traffic. Six employees, including Employee #1 (fatally injured), were exposed to struck-by hazards in the westbound right lane without a traffic control plan, written procedures, or a program addressing roadway work safety.

29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about June 25, 2025, at 6250 NW Barry Road, Kansas City, MO, the employer did not instruct employees in the avoidance of roadway work hazards. Six employees, including Employee #1 (fatally injured), were assigned to work in the westbound right lane of Barry Road without training on struck-by hazards from vehicular traffic, safe positioning while working in active lanes, or the proper setup and limitations of traffic control devices such as cones and signage.

29 CFR  1926.200(g)(1):Construction areas were not posted with legible traffic signs and protected by traffic control devices at points of hazard:  On or about June 25, 2025, at 6250 NW Barry Road, Kansas City, MO, employees of CAP Asphalt were working in the westbound right lane without posting warning signs to notify motorists of a lane closure or workers in the roadway. Six employees, including Employee #1 (fatally injured), were exposed to struck-by hazards from vehicular traffic due to the absence of warning signage.

29 CFR  1926.200(g)(2): Traffic control signs or devices, including signs, signals, markings, barricades, and other devices, used for protection of construction workers, did not conform to Part 6 of the Manual of Uniform Traffic Control Devices ("MUTCD"), incorporated by reference in 29 CFR 1926.6:  At the construction site located at 6250 NW Barry Road in Kansas City, Missouri: On or about June 25, 2025, employees were engaged in road asphalt repair activities for the employer within the roadway without utilizing, at a minimum, class 2 high visibility garments.  Reference: 1926.6(n)(1) - Manual on Uniform Traffic Control Devices for Streets and Highways, 2009 Edition, December 2009 (including Revision 1 dated May 2012 and Revision 2 dated May 2012), ("MUTCD") IBR approved for §§1926.200(g) and 1926.201(a).  Or, in the alternative:   OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to workers/employees exposed to struck-by hazards while performing work on active roadways:   At the construction site located at 6250 NW Barry Road in Kansas City, Missouri: On or about June 25, 2025, employees engaged in asphalt repair activities within an active roadway, for the employer, were exposed to being struck and run over by vehicles.
