29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) On or about June 25, 2025, the employer did not ensure that employees conducting sewer line repairs inside an excavation that was in excess of 5 feet deep with near vertical walls were protected from cave-in hazards in that an adequate protective system was not being utilized. Employees entered the unprotected trench measured at approximately 10 feet deep which resulted in a cave-in.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On or about June 25, 2025, and at times prior, the employer did not ensure that inspections of the excavation, adjacent areas, and protective systems were conducted by a competent person while employees were conducting sewer line repairs inside an excavation that was in excess of 5 feet deep. Employees entered the unprotected trench measured at approximately 10 feet deep which resulted in a cave-in and an employee being hospitalized.
